Ex-Atlanta cop charged in vicious 15-minute beating of man for walking on the street

Nicholas J. Dimauro, 32, a former officer with the Atlanta Police Department was indicted Tuesday by a Fulton County Grand Jury for the brutal assault of a man who Dimauro said was walking illegally on a public street.

According to the Atlanta Journal-Constitution, Fulton County District Attorney Paul Howard’s office said Dimauro is facing indictments on two counts of aggravated battery, two counts of violation of oath by a public officer and one count of aggravated assault.

The incident in which Dimauro is charged took place in 2010. Around 3:00 a.m. one late night, Robert Wormley was returning to his home when he was confronted by then-Officer Dimauro. According to Dimauro, Wormley was walking illegally on a public street and ran when Dimauro tried to stop him for questioning.
DA’s office spokesperson Marla Robinson said that when Dimauro caught Wormley behind a house on Hood St., a witness reported seeing Dimauro knock the fleeing man to the ground and strike him with a tactical baton and kick him for at least 15 minutes.

Wormley was left with cuts and abrasions to his face, three broken ribs, a collapsed lung, a broken wrist and a gash on the back of his skull that required five surgical staples to close.

Dimauro was fired from the Atlanta Police Department after another beating of a civilian in 2011. He was reinstated, however — with back pay — in 2013 by the Atlanta Civil Service Board. He retired from the force shortly thereafter.
