Officer charged in death of tasered man

(CNN) — A Louisiana grand jury indicted a former police officer on a manslaughter charge in the death of a man who was Tasered nine times while handcuffed, prosecutors said Wednesday.

Scott Nugent also was charged with felony criminal malfeasance in connection with the January death of Baron “Scooter” Pikes.

Pikes, a 21-year-old sawmill worker, tried to run from Winnfield police, who wanted to arrest him on a warrant charging him with cocaine possession.

A coroner’s report found that Pikes was handcuffed and on the ground when first stunned with a Taser and might have been dead before the last two 50,000-volt shocks were delivered.

Nugent, who authorities said was the arresting officer, was suspended and ultimately fired in May.

If convicted, Nugent could get up to 40 years for the manslaughter charge and five years for the criminal malfeasance charge, Winn Parish District Attorney R. Chris Nevils said.

“It is our intention to show at trial that Mr. Nugent caused the death of Baron Pikes by Tasing him multiple times, unnecessarily and in violation of Louisiana law, and by failing to get him medical attention when it was apparent he needed it,” Nevils said.

The indictment stems from a state police investigation into the death, which ended in late July.

Nugent’s attorney, Phillip Terrell, could not be immediately reached for comment Wednesday evening. He said earlier that his client had followed proper police procedure.

A copy of the Winnfield Police Department’s Taser training manual, obtained by CNN, says the device “shall only be deployed in circumstances where it is deemed reasonably necessary to control a dangerous or violent subject.”

Nugent is white; Pikes was black. Pikes’ death led to demonstrations that drew several dozen people in Winnfield, Louisiana, a town of 15,000, roughly half of whom are black.

Police said Pikes told officers he suffered from asthma and had been using PCP and crack cocaine. But Dr. Randolph Williams, the Winn Parish medical examiner, said he found no sign of drug use in the autopsy and no record of asthma in Pikes’ medical history.

Lt. William Strong, son of a military family, tired of his wife’s unfaithfulness and filed for divorce. The unfaithful wife retaliated by accusing Strong of rape. There was no evidence of rape, but Strong was deceived into a plea bargain. Once Strong entered a plea, he was double-crossed and given 60 years.

Christophe Gaynor took an adolescent skateboard team to New York City for a competition. One of the kids attempted to buy illicit drugs. Gaynor threatened to tell the boy’s parents, and the boy pre-empted Gaynor by accusing him of sexual molestation.
Gaynor was openly framed in the Arlington, Virginia, court system.

Americans, or, perhaps more accurately, some Americans, were horrified by the photographs showing the torture of Iraqi detainees in Abu Ghraib by the U.S. military. The Senate Armed Services Committee has issued a report, which concludes that the torture policy originated at the highest level of the Bush administration. Those Americans with a moral conscience have reeled under further revelations – the torture of Guantanamo detainees, the transport of people seized by U.S. authorities to Third World countries to be tortured. ……………..Why weren’t our soldiers shocked instead at the immorality of their leaders?One answer is that the U.S. military no longer operates according to a code of honor. Military discipline in the traditional sense does not exist. The ethos of the U.S. military has degenerated into kick-ass macho. Major General Taguba, who, instead of covering up the Abu Ghraib scandal, attempted in his report to hold the U.S. military to its traditional principles, was forced to resign from the U.S. Army.

Another answer is that the work of torture, like police work and prosecutorial work, attracts brutal people who enjoy inflicting harm on others. The two Republican female U.S. attorneys in Alabama who framed Democratic Governor Seligman enjoyed ruining Seligman and bringing grief to his family.

Deborah Davies of the BBC’s Channel 4 undertook a four-month investigation of the torture of American prisoners inside American prisons. Videos taken by sadistic prison guards and videos recovered from surveillance cameras reveal horrible acts of torture and even of murder of prisoners by prison guards.

An American prison reformer told Deborah Davies, “We’ve become immune to the abuse. The brutality has become customary.”

“Law and order conservatives” have a great responsibility for this evil. Just as “law and order conservatives” created hysteria among the people about crime, they created hysteria about terrorists. Hysterical people condone great evils and arm government with power in the mistaken belief that it will protect them.

What kind of people have we become when we exercise no oversight over a criminal justice (sic) system that destroys the lives of innocent people and locks them away in prisons to be tortured by sadistic guards?

Salaam——–IN THE NAME OF ALLAH, THE GREAT MAHDI, THE MOST MERCIFUL!—The following is from:December 22, 1967 edition of Muhammad Speaks Newspaper ———–” The beast mentioned in Revelation 4:6-8, is not a real four-footed beast. It is human beings referred to as a beast, because their characteristics and nature are similar to those of a beast. Therefore, we refer to this language as being symbolic language.

THE ONLY people we know of whose characteristics symbolize the beast’s actions is the white race, who once lived a beast’s life in the caves and hillsides Europe, and who lives like a savage beast without human civil actions of love and sympathy for human beings of righteousness. Therefore, their future destruction of human beings through disagreement, mischief-making and wars was prophesied.

The prophet described them as a beast. Four are mentioned in the Revelation, which all religions scientists agree refer to four great governments of the white race in the last days of their rule on the earth.

MOST OF the Revelation, entitled John the Revelator and the Apocrypha, if the reader understands it, refers to the prophecy or history of the white race mixed with the prophecy of God and especially the work of God in bringing about an end of their power to rule the righteous.

Their number is referred to as being six and their total time to rule the nations is 6,000 years. Their number is also referred to as 666 (Revelation 13:18). I do not have time and space to go into an analyzation and interpretation of the 666. You will find it in other literature I have written.

TODAY, God, in the Person of Master Fard Muhammad, has revealed this truth and has opened their eyes to more knowledge than they ever knew. This knowledge is given to a people just prior to their destruction. He allows them to take a peek into the Knowledge of God and His power so that they will not make the mistake of trying to attack the Creator, which will be a losing battle.

The white race-especially America- ruling over the Black people (her slaves, the so-called Negroes), beating and killing them day and night, corresponds with a savage beast. What is causing a divine judgment of justice to come upon America is her cruel and evil treatment of her slave, the so-called America Negro, to whom she has never, according to her history, shown mercy and leniency in giving them freedom, justice and equality or giving them an equal chance to qualify themselves as equals with other civilized nations of the earth, to win the love and respect of their own people. THIS IS proved by the time and what is now being granted to the Negro from God, Master Fard Muhammad. For the first time, they now can gain the respect of self and others. Knowledge of self and God is the foundation of wisdom of self.

It would have been impossible for the white race to rule the Black Nation, if the Black Nation had not been deprived of the knowledge of the wicked ruler (the white race) in the very beginning of his rule.

FOR 600 years, while they were in the making, the Black man was deprived of the knowledge of what was being made to rule him. Only the major scientists of the Black man knew, but they kept it a secret so they would not deprive the enemy of ruling the people, since they wanted to know how masses of people would react under a ruler of evil instead of a ruler of good. We always had been ruled by good and righteousness so the white race was made as a trial upon us to see how we react under evil and to see if evil could dominate us 100 per cent. If so, then evil would be equal to good.

BUT, EVIL could not capture us 100 per cent, within 6000 years, due to the Mahdi (Messiah) being born at the end of 6,000 years from the birth of Yakub (the father of the white race), whose wisdom was limited to the birth and coming of the Great Mahdi, God in Person, (of the righteous).

The coming of the Mahdi as being One greater in knowledge and greater in wisdom than Yakub was seen and prophesied by Yakub and he prophesied His coming after him to destroy his civilization in Revelation. …………..”

Coming to grips with her enclosed environment, it dawned on her that she did not know how to unbuckle her seat belt either. Panic began to take hold.

Her solution was to scrounge up a steak knife and cut through the straps, eventually finding her way into the confusing world of the parking lot. It was not long before the police were called.

Virginia, an 84-year-old African American, has Alzheimer’s disease. Like many other sufferers, the responsibility for her care fell to her adult child. Her daughter, however, was inside the store.

It was only a short matter of time before the police were called.

As she wandered the parking lot calling her daughter’s name, she was approached by a white, female officer who clearly ordered her to drop the weapon. She did not.

What happened next was captured on video and uploaded that same night to YouTube by user “mainetaine187,” who says on camera as the scene escalates, “We gotta get real footage of this nuts, haha!”

A witness to the scene, one Tomya Beatty, quoted by the local NBC affiliate station, said: “She didn’t even ask her to drop the knife. The woman told her when the cop came charging at her. She said, ‘I’m not going to cut you. I’m not going to cut you.’ She was just calling her daughter’s name out.”

While the video contradicts Beatty’s statement that the officer said nothing about the knife, the use of force against an obviously frail woman is apparent. As the video progresses, a noisy scene develops around the officers as the confused old woman lays on the ground, bleeding.

Beatty, again quoted by NBC, said, “There was about to be a riot in front of Walmart…”

Another alleged witness, YouTube user “MisssBoo76,” wrote that the woman was “swinging a knife at people, when the police arrived she wouldn’t drop the knife so the police officer took her down, the lady also assulted [sic] a kid by hitting him which sparked the crowd of people outside anyway…”

During the video, a male police officer can be heard shouting at the crowd: “We’re not gonna hurt her! Step back!” Moments later, an unseen male asks, “What would you do if someone slammed your mother to the ground?”

The narrator adds: “Officer Fullerton of the Whitehall Police Department.” He picked up a phone and called someone, then continued: “Yeah, I’m out here… sitting here watching these police beat up an 80-year-old old lady, man. Yeah, you know this is going on the news tonight, bro. I got the news footage.”

“Dotson’s daughter said her mother needed stitches to close the wounds and her hand may have been broken,” added NBC4i.

Police declined to press charges against the woman, who was released back into her daughter’s custody.

“What’s got me is that since it’s obvious the female officer (proving that its not a gender-based issue) was strong enough to take her down with ease, why not just grab the knife from her instead?” asked San Francisco Chronicle blogger zennie62.

He continued: “To me, police officers are supposed to be trained to be super people in judgment not just strength. Yes, I know that what they do is dangerous, but the job doesn’t have to be a thankless one. Somewhere along the way, deep in our long term backslide in education spending and the decline of leisure time we produced a society of people impatient to study a situation then react in a non-violent way.”

The man responsible for this even becoming news, YouTube user mainetaine187, opines, “I think excessive force was used.”

But, he concludes, “U be the judge…..”
